  4. This End-User License Agreement ("EULA") is a legal agreement between
  5. you (either an individual or a single entity) and bleem, LLC for the
  6. bleem software accompanying this EULA, which includes computer software
  7. and may include associated media, printed materials, and "online" or
  8. electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE").

  10. By exercising your rights to use the SOFTWARE PRODUCT, you agree to be
  11. bound by the terms of this EULA.

  13. If you do not agree to the terms of this EULA, you may not use the
  14. SOFTWARE PRODUCT.

  17. SOFTWARE PRODUCT LICENSE

  20. The SOFTWARE PRODUCT is protected by copyright laws and international
  21. copyright treaties, as well as other intellectual property laws and
  22. treaties.  The SOFTWARE PRODUCT is licensed, not sold.

  25. 1.  GRANT OF LICENSE.

  27. This EULA grants you the following rights:

  29. Installation and Use -- You may install and use a single copy of the
  30. SOFTWARE PRODUCT.

  32. Reproduction and Distribution -- You may NOT reproduce or distribute
  33. copies of the SOFTWARE PRODUCT or its component parts, except and only
  34. to the extent that such activity is expressly permitted by applicable
  35. law notwithstanding this limitation.

  38. 2.  DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  40. a) Limitations on Reverse Engineering, Decompilation, and Disassembly:

  42. You may NOT reverse engineer, decompile, or disassemble the SOFTWARE
  43. PRODUCT, except and only to the extent that such activity is expressly
  44. permitted by applicable law notwithstanding this limitation.
  45.  
  46. b) Separation of Components:
  47.  
  48. The SOFTWARE PRODUCT is licensed as a single product -- Its component
  49. parts may not be separated for use on more than one computer.
  50.  
  51. c) Software Transfer:
  52.  
  53. You may permanently transfer all of your rights under this EULA, provided
  54. the recipient agrees to the terms of this EULA.  Such transfer must include
  55. any and all copies of the SOFTWARE PRODUCT and its component parts.
  56.  
  57. d) Termination:
  58.  
  59. Without prejudice to any other rights, bleem, LLC may terminate this EULA
  60. if you fail to comply with the terms and conditions of this EULA.
  61.  
  62. In such event, you must destroy all  copies of the SOFTWARE PRODUCT and
  63. all of its component parts.
  64.  
  65.  
  66. 3.  COPYRIGHT.
  67. --------------
  68. All title and copyrights in and to the SOFTWARE PRODUCT (including, but not
  69. limited to, any images, photographs, animations, video, audio, music, text,
  70. and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying
  71. printed materials, and any copies of the SOFTWARE PRODUCT are owned by
  72. bleem, LLC or its suppliers.
  73.  
  74. The SOFTWARE PRODUCT is protected by copyright laws and international treaty
  75. provisions.  Therefore, you must treat the SOFTWARE PRODUCT like any other
  76. copyrighted material.

  79. 4.  U.S.  GOVERNMENT RESTRICTED RIGHTS.

  81. The SOFTWARE PRODUCT and documentation are provided with RESTRICTED RIGHTS.

  83. Use, duplication, or disclosure by the Government is subject to restrictions
  84. as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  85. Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and
  86. (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19,
  87. as applicable.

  92. 5.  LIMITED WARRANTY.  NO WARRANTIES.

  94. bleem, LLC expressly disclaims any warranty for the SOFTWARE PRODUCT.

  96. The SOFTWARE PRODUCT and any related documentation is provided "as is"
  97. without warranty of any kind, either express or implied, including,
  98. without limitation, the implied warranties or merchantability, fitness
  99. for a particular purpose, or noninfringement.
  100.  
  101. The entire risk arising out of use or performance of the SOFTWARE PRODUCT
  102. remains with you.
  103.  
  104.  
  105. 6.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

  107. In no event shall bleem, LLC or its suppliers be liable for any damages
  108. whatsoever (including, without limitation, damages for loss of business
  109. profits, business interruption, loss of business information, or any other
  110. pecuniary loss) arising out of the use of or inability to use this bleem,
  111. LLC product, even if bleem, LLC has been advised of the possibility of such
  112. damages.

  114. Because some states/jurisdictions do not allow the exclusion or limitation of
  115. liability for consequential or incidental damages, the above limitation may
  116. not apply to you.

  118.  
  119. 7.  MISCELLANEOUS.

  121. If you acquired this product in the United States, this EULA is governed
  122. by the laws of the State of California.
  123.  
  124. If this product was acquired outside the United States, then local laws
  125. may apply.
